Transparency and information access are two essential conditions for the running of a democratic system, which have to balance with the individual privacy right and confidentiality of specific information, justified by economic and collective safety reasons.

We consider that information access should be a civic right since it makes possible the personal development of individuals and allows them to take part, at their full capability, in collective affairs management, as well as to control the decisions of political representatives and public administrators. Consequently, we are committed to:

Achieve that transparency becomes a proactive duty to inform, and a usual practice within public administrations and entities involved.
All economic internal information of Public Administrations has to be published so it can be consulted in a simple way by citizenry.
Guaranteeing the citizens right to the full access, in an open, simple and free way, to any sort of information, data, and documentation, generated in projects which have been publicly subsidized, always respecting privacy and private data protection. Knowledge generated by public funds must be open and for everyone.
Disclosing elected officials wealth both before elections and during the term of office. Also publishing regular reports of their activities as politicians, by detailing consultations and meetings held by them, as well as both justification and outcomes of such activities.
Claiming the full transparency concerning economic activity of political parties, that is, detailed information of both income sources and expenses.
Transparency exceptions, because of privacy rights, national safety, precautionary measures and fight against crime, etc., must be clearly listed and determined, without letting administrations nor organizations which have to provide such information, to decide about its corresponding interpretations.
Guaranteeing privacy and confidentiality of the information about persons and organisms, because of intimacy right or economic reasons, established by law, particularly before new ICT, growing data bases, and electronic surveillance systems existing in our society. In the case of people having public functions, this principle is subordinate to the aforementioned transparency principles.
Overall, making accessible all the non-sensitive information, of interest to citizenry, in a public manner through the Internet, and promoting creation of tools which add value, provide additional informations or improve its visualization.
Fostering tecnological infrastructure saving, by means of open source software, which guarantees safety in the personal data treatment and, on the other hand, will promote the creation of companies dedicated to supporting them.

In deutschen Behörden galt bisher der Grundsatz der Amtsverschwiegenheit. Um in Akten der öffentlichen Verwaltung einsehen oder aus ihnen Auskünfte erlangen zu können, musste ein berechtigtes Interesse nachgewiesen werden.

Nahezu alle westlichen Industrienationen gewähren dagegen zum Teil schon seit längerem ein voraussetzungsloses jedermanns Recht auf Akteneinsicht und Aktenauskunft, ohne dass die Anträge begründet werden müssen. Erst seit wenigen Jahren gewinnt Deutschland langsam Anschluss an diesen internationalen Standard.

Immer mehr setzt sich auch hier die Erkenntnis durch, dass Transparenz der öffentlichen Verwaltung nicht nur die demokratischen Beteiligungsrechte der Bürgerinnen und Bürger stärkt und damit der Staatsverdrossenheit entgegenwirkt, sondern dass sie Manipulationen und Korruption erschwert.

Jedermann hat, ohne einen Grund für seinen Antrag angeben zu müssen, grundsätzlich freien, ersatzweise beschränkten Informationszugang zu allen – hoheitlichen und fiskalischen – Verwaltungsvorgängen.

Zur Wahrung dieses Rechts stellt die Piratenpartei folgende Mindestanforderungen an Informationsfreiheitsgesetze (IFG):

• Ausnahmen, zum Beispiel der Schutz besonderer öffentlicher Belange sowie personenbezogener Daten und Betriebs- und Geschäftsgeheimnissen, sind eng und nur unter Abwägung mit ggf. höherrangigen Rechten zuzulassen.
• Die Akteneinsicht und Aktenauskunft hat innerhalb einer vorgeschriebenen kurzen Frist zu erfolgen.
• Die für die Akteneinsicht zu erhebenden Verwaltungsgebühren sind so zu gestalten, dass sie das Informationsrecht der Bürgerinnen und Bürger nicht behindern.
• Einfache Auskünfte und die Einsichtnahme in Akten bei nur geringem Verwaltungsaufwand sollten grundsätzlich kostenlos sein.
• Ablehnungen von Anträgen sind zu begründen und müssen gerichtlich nachprüfbar sein.
• Die Einhaltung der Informationsfreiheitsgesetze ist durch einen Informationsfreiheitsbeauftragten, an den sich jeder beschwerdeführend wenden kann, zu überwachen.

So far, German authorities have worked under the assumption of official secrecy. In order to view public administration records or retrieve information from them, citizens needed to prove a legitimate interest. However, almost all industrialized Western countries give everyone the right to view records or retrieve information from them, without the need to legitimize their requests. Germany has only been catching up to this international standard over the last few years. More and more people are beginning to understand that a transparent public administration not just strengthens the democratic participation of all citizens and decreases political alienation, but also makes it more difficult for officials to engage in manipulation and corruption. Everyone has full access to all authoritative and fiscal administrative procedures, without having to provide justification for their inquiry. To protect this right, the Pirate Party demands the following minimum conditions for freedom of information laws:

• Exceptions, such as the protection of public interests, personal data and business secrets, must only be permitted where reasonable evidence can be provided and only under consideration of superordinate laws.
• People must be able to view and request information from records within a short, specified timeframe.
• The administrative fees for viewing records must be such that they do not obstruct the citizens’ right to free information.
• Simple requests and viewing of records which require little administrative work should always be free.
• Rejections of requests must be justified and must be verifiable by a court.
• The adherence to freedom of information laws must be monitored by a freedom of information officer, whom everyone can contact with complaints.
