14 PPEU's Relations to the European Parliament

ARTICLE 4
Membership
4.3.4 Special Category Membership
Elected Members of the European Parliament (“MEPs”) who are part of the GGEP and who belong to an EGP member party are automatically granted special category membership in accordance with the regulations governing political parties at European level and the rules regarding their funding.
Elected Members of the European Parliament who are part of the GGEP but who do not belong to a European Green Party Full, Candidate or Associate Member can be granted special category membership by a decision of the Council.
All such MEPs exercise their membership collectively and exclusively through the GGEP delegation.
ARTICLE 5
Relations with the Green Group in the European Parliament (“GGEP”) and the Federation of Young European Greens (“FYEG”)
5.1 The European Green Party is exclusively represented in the European Parliament by the GGEP or its successors and the GGEP in turn represents the special category (MEP) members within the EGP.
5.3 Both the GGEP and the FYEG are entitled to appoint delegates to meetings of the European Green Party, including Council meetings, and to vote thereat.

Structure and Bodies of the European Green Party
6.3 Council
6.3.4 The composition of delegations for Council meetings is based on the principle of a minimum of two delegates per Member. (…) In addition, GGEP and FYEG have the right to appoint delegates to Council and to vote.
6.3.6 All delegates from one Member or from the GGEP or the FYEG constitute a delegation.
6.4 Congress
6.4.2 The composition of delegations for Congress meetings is based on the principle of a minimum of four delegates per Member. (…) In addition, GGEP and FYEG have the right to appoint delegates to Congress and to vote. Full regulations for the conduct of Congresses are set out in the Rule Book.

I. Membership
Article 1 Membership Categories
1.5 Special Members are elected Members of the European Parliament who are part of theGGEP and who belong to an EGP Member. They are automatically granted special category membership in accordance with the regulations governing political parties at European level and the rules regarding their funding.

Elected Members of the European Parliament who are part of the GGEP but who do not belong to an EGP Member can also be granted special category membership by Council by a threequarters majority of the Allocated Votes.
All such MEPs exercise their membership collectively through the GGEP.
1.6 In addition to the membership categories listed above, the European Green Party has three European partners:
• the Green Group in the European Parliament (GGEP),
• the Green European Foundation (GEF) and
• the Federation of Young European Greens (FYEG),
which participate in the activities of the European Green Party as defined in Article 36 below.
Article 2 Membership Criteria
2.4 Special Members are:
• Elected MEPs from Full, Candidate and/or Associate Members who have joined the
GGEP;
• Any MEP who has joined the GGEP and who is not a member of a Full, Candidate or Associate Member and wants to become a Special Member of the European Green Party shall apply in writing to the Committee. This request shall be confirmed by the MEP annually in writing as part of the annual Grant application by the European Green Party to the European Parliament.
2.5 Every such application has to be approved by the Council upon a proposal by the Committee. If there is a Full Member in the country of election of the MEP, the Committee will consult the Full Member concerned.
2.6 Criteria for acceptance as Special Member are:
• The request is made by a Member of the GGEP;
• The MEP respects the values in the Green Charter of the European Green Party and the Global Greens Charter.
Article 3 Membership Rights
3.4 Special Members exercise their membership rights exclusively through the GGEP delegation, as stated in the Article 1.4.
Article 5 Procedure for admitting new Members
5.12 Where an applicant has MEPs, or is likely to, the Committee shall consult the GGEP and inform the Council of their views.
II Council
Article 7 Composition and powers
7.3 The Council shall consist of delegates representing Full Members, GGEP and FYEG determined according to the Rules for the allocation of delegates and votes as provided for in Article 10. (…)
7.4 The Council:

• advises the Green Group in the European Parliament on their decisions on the admission of MEPs who do not belong to a Member of the European Green Party, after consultation with the national Green party concerned; (…)

III Congress
Article 12 Composition and powers
12.3 (…) In addition, GGEP and FYEG have the right to appoint six delegates each to Congress and have the right to six votes each.
IV Committee
Article 14 Composition
14.2 Only one of the posts of the European Green Party Co-Chairs may be held by a sitting MEP.
Article 17 Co-Chair
17.2 The Co-Chairs shall:
• in conjunction with the Secretary-General, initiate and conduct diplomatic and working relations with the GGEP, party and parliamentary representations of Members of the European Green Party, and of Green and other Parties outside the European Green Party or outside Europe as well as NGOs and other external societal organisations.
Article 18 Treasurer
18.2 The Treasurer shall:

Article 26 Resolutions

26.1 Eligibility for tabling
The Committee, Full Members, the GGEP delegation and FYEG are entitled to table draft Resolutions in their own right. Working groups and networks are entitled to table draft Resolutions if they are of relevance to the subject the network/working group is dealing with. Candidate Members need the support of four other signatures of those who are eligible to table draft Resolutions.
26.5 Emergency Resolutions
An issue of great urgency arising after the deadline for draft Resolutions may be dealt with by an Emergency Resolution tabled by the Committee or by a minimum of 5 out of Full Members, the GGEP delegation, FYEG, working groups, networks and Candidate Members under the same conditions as for Resolutions, before noon of the day before the opening of the Council. Article 27 Policy Papers
27.2 Initiating a Policy Paper
The Full and Candidate Members, the GGEP delegation and FYEG are entitled to propose to the Committee a subject for a policy paper as also are working groups and networks if policy papers are of relevance to their work. (…)
X Common European Union Election Campaigns
Article 28 European election campaign
28.1 The European Green Party is responsible for the preparation and coordination of the CommonEuropean Election Campaign in close cooperation with the GGEP and EU Member Parties.
28.2 The European Green Party Committee will propose to the Council a detailed project for the:
• preparation of a common election political agenda (election manifesto);
• preparation and development of a common European election campaign and support for Members as appropriate;
• organisation of and support for any future election process for transnational candidates.
Article 29 Common campaigns
29.1 The European Green Party will seek to develop the instrument of common campaigning building on the strength of cross-border and European-wide cooperation on political policies and issues. However European cooperation in common campaigns must respect specific national realities and cultural diversity.
XIII External representation
Article 36 European Partners
36.1 The European Green Party acknowledges three partners on the European level: the Green Group in the European Parliament (GGEP), the Green European Foundation (GEF) and the Federation of Young European Greens (FYEG). The European partners are mutually committed to a strong cooperation. They are jointly responsible for regular consultation and coordination to ensure that our combined resources are employed as efficiently as possible and that the Green presence is enhanced. The European Green Party has as its specific responsibility the coordination and consultation on all matters concerning Green Party Members.

36.2 The EGP, the GGEP, GEF and the Members are equal partners in the European political space. Their respective roles are largely defined by the applicable European regulations. In general the role of the EGP is to elaborate a longer-term perspective. Where its Members look to the EGP to help them formulate political commentaries or where there are events of major and lasting significance, the EGP may respond as the collective Green voice.
36.3 The constituency of the EGP is considerably wider than that of the GGEP, being represented in almost all 27 EU member states, as well as in non-EU countries. This provides a larger sphere of influence and enables the EGP to build on the work of the GGEP.
36.4 The EGP, in collaboration with FYEG, should encourage capacity building and strategic human resources development of political talent at European level in co-operation with GEF and the GGEP.
36.5 The Green Group in the European Parliament (GGEP) GGEP holds the exclusive political representation of European Green Party members at the European Union political level. The coordination between the two bodies is guaranteed at executive level by mutual representation of their Secretaries-General at respectively the European Green Party Committee and the Green Group’s Bureau.
The GGEP participates in the decision making process of the European Green Party by its representation in the Council of its four delegates and by its four votes. All members of the Green Group (MEPs) are exclusively represented in the EGP by the Green Group's delegation to the EGP Council.
The GGEP is welcome to nominate representatives to and participate in the Working Groups and Networks of the European Green Party.
In all matters concerning the European elections the European Green Party and the Green Group in the European Parliament shall consult each other on a regular basis and shall contribute within the limits of each other’s responsibilities.

Article 11
Before election to the European Parliament, a Congress or Electoral Conference must be convened at least six months before the European elections.
The Chairperson
Article 21
The Chairperson has to perform the following tasks with help of the Secretariat:

- maintaining the contact of the EL with the Parliamentarian Groups in which there will be deputies of Left parties in the EP and other European /international institutions etc.;
- representing the EL in the contacts with representatives of organisations and institutions, including the EU authorities, Trade Unions, non-governmental organisations and associations.
The Vice-chairpersons/s support/s the Chaiperson in fulfilling his/her duties.

Article 18 – Powers of the Congress
18.2. The PES Congress shall:
● adopt resolutions and recommendations to parties, the Presidency and its group in the
European Parliament ;
Article 19 – Composition of the Congress
19.1. The PES Congress shall consist of the following delegates with voting rights:
● a representative from each National delegation of the Group in the European Parliament;
19.2. The PES Congress shall also consist of the following delegates without voting rights:
● all members of its political groups in the European Parliament and the Committee of the Regions not covered by art. 19.1.;
19.5. The following are also ex-officio delegates, without the right to vote:
● the President of the European Parliament if he/she is a PES member;
● PES members of the European Commission;
● the President of the European Council, if he/she is a PES member;
● the President or 1st Vice-President of the Committee of the Regions, if he/she is a PES member;
Article 22 – Powers of the Council
22.2. The PES Council can adopt resolutions and recommendations to the member parties and organisations, the Presidency, the Congress and its group in the European Parliament in full respect of the Congress being the supreme organ of the PES.
22.3. The Council adopts the PES Manifesto for the European elections.
Article 23 – Composition of the Council
23.1. The PES Council shall consist of the following delegates with voting rights:
● representatives of the its group in the European Parliament, equal to 25% of the number of National delegations, rounded upwards;
23.2. The PES Council shall also consist of the following delegates without voting rights:
● a delegation of its political groups in the European Parliament and the Committee of the Regions, equal to 25% of its members, rounded upwards;
23.4. The following are also ex-officio delegates, without the right to vote:
● the President of the European Parliament if he/she is a PES member;
● PES members of the European Commission;
● the President of the European Council, if he/she is a PES member;
● the President or 1st Vice-President of the Committee of the Regions, if he/she is a PES member;
Article 27 – Composition of the Presidency
27.1. Members of the PES Presidency with voting rights are:
● the President of its group in the European Parliament;
27.3. The following are also ex-officio members of the Presidency, without the right to vote:
● the President of the European Parliament, if s/he is from a PES member party;
● one representative from the PES Members of the European Commission.
Article 30 – The President
30.1. The President, with the assistance of the Secretariat, shall ensure:
● liaison between the PES and the parties, the group in the European Parliament and the Socialist International;
● representation of the PES in any organisation or institution, in particular, the institutions of the European Union, European trade unions, professional organisations, co-operatives and associations.
30.2. The decisions of the Congress, the Council, the Leaders’ Conference and the Presidency are executed by the President of the PES in co-operation with the Vice-Presidents and the Secretary General, other office holders of the Presidency and the President of its group in the European Parliament.
Article 32 – Composition of the Leaders’ Conference
32.1. The Leaders’ Conference consists of:
● the President of the European Parliament, if he/she is a PES member;
● two representatives from the PES Members of the European Commission, including the High Representative of the Union for Foreign Affairs and Security Policy, if he/she is a PES member;
● the President of the European Council, if he/she is a PES member;
● the President or 1st Vice-President of the Committee of the Regions, if he/she is a PES member.
32.2. Once a year the President shall also invite the Leaders of the Associate Parties and Organisations to a meeting of the Party Leaders' Conference.

III. AGENDA AND TIMETABLE OF THE CONGRESS
4. Items, including draft resolutions, for the agenda may only be submitted to the secretariat of the ELDR Party, not less than two months prior to the Congress, by full member parties, one third of the Members of the European Parliament who are signed up to the ELDR Party or the Bureau of the ELDR Party.
6. Amendments to draft resolutions may only be submitted to the secretariat not less than four weeks prior to the Congress, by full member parties, one third of the Members of the European Parliament or Committee of the Regions who are signed up to the ELDR Party or the Bureau of the ELDR Party.
9. The Council, any full member party, twenty-five Congress delegates or one third of the Members of the European Parliament who are signed up to the ELDR Party, may propose urgency draft resolutions to be added to the agenda. These must relate to current or recent political events which could not have been dealt with in the draft resolutions two months prior to the Congress. The Congress shall decide whether to debate urgency draft resolutions.
11. Prior to European parliamentary elections an electoral manifesto must be discussed and adopted. Amendments may be submitted by any full member party, the Council, twenty-five Congress delegates or one third of the Members of the European Parliament who are signed up to the ELDR Party.
13. The parliamentary Group of the ELDR Party shall report on its activities to the Congress
IV. PARTICIPATION AND REPRESENTATION AT THE CONGRESS
1. The following delegates shall be entitled to attend the meetings of the Congress with voting rights:
Delegates of full member parties whose number shall be allocated as follows:
d) Members of the Bureau and Members of the European Parliament who are delegates of full member parties;
2. The following delegates will be entitled to attend the meetings of the Congress, without voting rights:
d) The ELDR members of the Group of the ELDR Party in the European Parliament and the Committee of the Regions;
e) One delegate from each established parliamentary group in other European parliamentary assemblies, who must not belong to a political party affiliated to any group in the European Parliament other than the parliamentary Group of the ELDR Party;
f) One delegate from Liberal International, who must not belong to a party affiliated to any group in the European Parliament other than the parliamentary Group of the ELDR Party.

VII. THE COUNCIL
2 The following persons will be entitled to attend the meetings of the Council, without voting rights:
c) One delegate from each established Liberal, Democrat and Reform group in European parliamentary assemblies, who must belong to an ELDR member party;

2. (…) The following persons shall be entitled to attend the meetings of the Bureau as observers, without voting rights:
b) If the President of the parliamentary Group of the ELDR Party in the European Parliament is unable to attend the meeting, the Secretary-General of this Group may attend by invitation of the Bureau.
c) If the President of the Group of the ELDR Party in the Committee of the Regions is unable to attend the meeting, the Secretary-General of this Group may attend by invitation of the Bureau.
d) If the President of the Group of the ELDR Party in the Parliamentary Assembly of the Council of Europe is unable to attend the meeting, the Secretary-General of this Group may attend by invitation of the Bureau.
XI. Members
4. Elected members
Elected members of full, affiliate or observer member parties sitting in any international or European assembly should belong to the Liberal, Democrat and Reform Group of that assembly.
XII. POLITICAL LEADERS
1. The Bureau shall convene the Political Leaders and Ministers Meeting at least twice a year to exchange views on items on the agenda of the European Council and the current European political situation.
2. The Political Leaders' Meeting shall include:
c) The President of the Group of the ELDR Party in the European Parliament;
d) The President of the Group of the ELDR Party in the Committee of the Regions;
3. The Bureau may invite leading personalities to take part in the meetings of the Political Leaders' Meeting e.g. leaders of affiliate or observer member parties or leaders of political parties which share the same liberal, democrat and reform values, members of the European Commission and Council who belong to a full member party, and the Presidents of the Liberal, Democrat and Reform Groups in other international fora.
EDPArticle 5: Relationship with the Group at the European Parliament.
The European Democratic Party may form an alliance with other european parties in order to establish an efficient Group for the promotion of its values within the European Parliament and within the other institutions or european bodies.
In this regard, All the appointed representatives of the parties members, or sole member must sit within a group defined by the competent bodies.
The Heads of Delegations of the different party members will establish close relations, will have regular meetings in order to decide the common positions and to assure the coherence of the positions of the EDP within the parliamentary group.
Item II: Affiliation
Article 7: Members
The association members are divided into six categories: the parties members, the individual members, the affiliated members, the observing members, the physical persons and the moral persons.
2. The individual members are members of European institutions
and organs provided by the treaties of national Parliaments and
of regional and local assemblies. These are either founding
members or admitted members to the party after its
establishment, in compliance with the rules imposed by these
statutes.
III THE PRESIDENCY
Article 23: Composition
The Presidency is composed of:
-One representative by national delegation of the member of the EDP to the Parliamentary group at the European Parliament.

The association is represented in the European Parliament by the Group of the European People’s Party (Christian Democrats) (Group of the EPP in the European Parliament).
Member parties oblige parliamentarians elected to the European Parliament on their list, and/or sent to the Committee of the Regions, or the Parliamentary Assemblies of the Council of Europe, the WEU, the OSCE and NATO, to join the EPP Groups therein.
II. MEMBERSHIP
Article 5
- Individual Members
In addition, all members of the EPP Group in the European Parliament elected on a list of a member party are also members ex officio of the association (hereinafter referred to as “Individual Members”). Other members of the European Parliament can become Individual Members of the association by decision of the Political Assembly on the proposal of the Presidency of the association. The speaking and voting rights of the Individual Members within the organs of the association are personal and inalienable.
IV. PRESIDENCY
Article 11
The association is managed by the Presidency, the executive organ. The Presidency is composed of:

(ii) the President of the European Commission, the President of the European Council, the High Representative on Foreign and Security Policy, the President of the European Parliament (to the extent that these persons are affiliated to the EPP);
(iii) the Chairman of the EPP Group in the European Parliament;
Except for the Honorary President(s) who are elected by the Political Assembly, and for the President of the European Commission, the President of the European Council, the High Representative on Foreign and Security Policy, the President of the European Parliament, the President of the Group of the EPP in the European Parliament, who are ex officio members of the Presidency, the members of the Presidency are elected by the Congress by secret ballot and by separate vote, for a renewable term of three years, exception made for the first nomination of the members of the Presidency immediately after the incorporation of the association, which will be carried out in accordance with the transitional provisions.
On the proposal of the President, and in accordance with the requirements of the agenda, the following persons may be invited to attend meetings of the Presidency:
- members of the European Commission who are member of a Member Party
- the President of the EPP Group at the Parliamentary Assemblies of the Council of Europe, the WEU, the OSCE and NATO as well as in the Committee of the Regions
The following persons are permanently invited:
- The Secretary-General of the EPP Group in the European Parliament.
V. POLITICAL ASSEMBLY
Article 15
The Political Assembly is the strategic organ of the association.
It is composed of:
a. members ex officio:
- members of the Presidency;
- members of the Presidency of the Group of the EPP in the European Parliament;

- Presidents of national delegations of member parties of the Group of the EPP in the European Parliament;
- Members of the Presidency of the European Parliament, of the European Commission
and of the Presidency of the Committee of the Regions, provided they belong to an Ordinary Member Party;
- Presidents of the EPP Groups in the Committee of the Regions and in the Parliamentary Assemblies of the Council of Europe, the WEU, the OSCE and NATO, provided that they are member of an Ordinary Member Party or Associate Member Party.
The mandate of these members of the Political Assembly ends when they loose the capacity in which they became member of the Political Assembly.
c. non voting members
- The Secretary General of the EPP Group in the European Parliament, and Secretaries General of the EPP Group in the Committee of the Regions and in the parliamentary Assemblies of the Council of Europe, the WEU, the OSCE and NATO;
Article 16
The Political Assembly has the powers attributed to it by the law, these by-laws and the Internal Regulations. Its competences consist inter alia of:
- ensuring unity of action by the EPP and influencing the achievement of European policy in the spirit of its program;
- stimulating and organizing systematic relations between national parliamentary groups and member parties in agreement with the Group of the EPP in the European Parliament;
Article 17
On the invitation of the President, the Political Assembly meets at least four times annually, whenever the object or the interest of the association so requires; an extraordinary meeting can be held at the request of either one-third of the Ordinary Member Parties and Associated Member Parties, or of the Presidency of the Group of the EPP in the European Parliament.
VII. SECRETARY GENERAL

This day to day management includes inter alia (ii) the supervision of
the cooperation between the General Secretariats of Ordinary Member Parties, Associated Member Parties and Member Associations and the General Secretariat of the Group of the EPP in the European Parliament,
IX. MODIFICATIONS OF THE BY-LAWS
Article 21
Proposals for modifications of the by-laws may be introduced by the Presidency, Ordinary Member Parties, Associated Member Parties or Member Associations and by the EPP Group at the European Parliament and the Presidents of the EPP Groups in the Committee of the Regions, the Parliamentary Assemblies of the Council of Europe, the WEU, the OSCE and NATO provided that they are member of an Ordinary Member Party or Associated Member Party.
Internal Regulations:
I. CONGRESS
a. Composition
The members of Congress are:
- Members of the EPP Presidency;
- The President of the European Council provided he is member of an Ordinary Member Party;
- The President of the Council of Europe if he is a member of an Ordinary Member Party;
- Individual Members of the Association (cf. article 5, alinea 4 of the by-laws) ;
- Members of the European Commission provided they are members of an Ordinary Member Party;
- Presidents of the EPP Groups at the Committee of the Regions, and at the Parliamentary Assemblies of the Council of Europe, the OSCE and NATO, provided that they are a member of an Ordinary Member Party or an Associated Member Party;
- Delegates of the EPP Groups in the Committee of the Regions and in the Parliamentary Assembly of the Council of Europe, provided that they are member of an Ordinary Member Party or Associated Member Party.
Delegates of Ordinary Member Parties, Associated Member Parties, Member Associations, the EPP Group in the Committee of the Regions and in the Parliamentary Assembly of the Council of Europe respectively form delegations.
The number of delegates from each Ordinary Member Party, Associated Member Party and Member Association is calculated in accordance with the number of delegate members of the Political Assembly. Members ex officio are not taken into account.
Member Associations and the Groups of the EPP in the Committee
of the Regions and in the Parliamentary Assembly of the Council of Europe are entitled to six delegates.
The following are invited to the Congress as guests:
- members of the Presidency of the EPP Groups at the Committee of the Regions and at the Parliamentary Assemblies of the Council of Europe, at the OSCE and NATO;
- parliamentarians of the Group of the EPP in the European Parliament who are not Individual Members of the association;
b. Functioning
The Political Assembly can decide to convene an extraordinary Congress. At the request of the Group of the EPP in the European Parliament or at least one-third of the Ordinary Member Parties and Associated Member Parties, the Political Assembly shall convene an Extraordinary Congress. The time period set out in the previous paragraphs shall be reduced to minimum three weeks.
A motion preventing valid deliberation may be introduced by:
- the presidency of the Congress;
- the Presidency of the EPP Group in the European Parliament.
III. EPP SUMMIT
a. Competences
The EPP Summit prepares the position to be taken by the EPP Heads of State and of Government at the European Council and issues recommendations on the strategy and political orientation of the association.
b. Composition
The EPP Summit is composed of:
- the members of the EPP Presidency;
- the members of the European Council (Heads of State and of Government), the President of the European Parliament and the President of the European Commission or a Vice-President to represent members of the European Commission, as far as they are a member of an EPP Ordinary Member Party;

Article 19
(1) The Congress shall consist of all Members of PPEU, all members of the Board, Pirate MEPs and Pirate members of national and regional parliaments and assemblies.
(2) Each participant shall nominate at least one delegate to represent them at the Congress.
